  • The Website is hosted on Framer, which manages site design, functionality, and user experience.

  • All purchases and transactions are processed via Shopify, which serves as the e-commerce platform for handling payments and checkout.

These Terms & Conditions apply to all users who access, browse, or make purchases on the Website.

1.2 General Terms & Conditions (GTC)
These General Terms & Conditions (GTC) outline the legal agreement between Vocal and its users. By using the Website, you acknowledge and agree to comply with these Terms. If you do not agree with any part of these Terms, you must immediately stop using the Website.

2.3 Mockups

"Mockups" refer to digital, editable design assets sold by Vocal, including:

  • Photo Mockups – High-resolution image-based mockups that can be edited.

  • Video MockupsVideo files that can be edited.

All Mockups are subject to licensing restrictions, as outlined in these Terms.

2.4 Licenses

"Licenses" define the permitted use of purchased Mockups. Vocal offers the following license types:

  • Standard License – For personal or non-commercial projects.

  • Commercial License – For use in business-related projects, including client work.

  • Commercial Plus License – An extended license for broader commercial use beyond the standard commercial license.

2.5 Agreement

"Agreement" refers to the legally binding contract between the User and Vocal, established when the User accesses, browses, or makes a purchase on the Website.

By using the Website, the User agrees to abide by these Terms & Conditions.


3. General Information


3.1 Website Ownership

The website vocalmockups.com (the "Website") is owned and operated by Vocal Designs Limited ("Vocal"), a company registered in England and Wales, with its registered address at 38 Red Lane, South Normanton, Alfreton, Derbyshire, DE55 3HA.

3.2 Service Availability

Vocal provides digital mockups to users worldwide, subject to local laws and regulations. While access to the Website is generally available 24/7, service availability may be affected by technical issues, scheduled maintenance, or external factors beyond Vocal's control.

3.3 Third-Party Hosting & Platforms

  • The Website is hosted on Framer, which provides site design and user interface functionality.

  • Transactions, payments, and order processing are handled through Shopify, which serves as the e-commerce platform.

  • Vocal may integrate third-party tools or services (e.g., payment processors, email marketing platforms) to enhance the Website’s functionality.

Vocal is not responsible for any disruptions, delays, or errors caused by third-party platforms or services. Users experiencing issues related to payments, hosting, or integrations should refer to the support services of the respective third-party provider.

3.4 Updates & Maintenance

Vocal reserves the right to update, modify, or temporarily disable parts of the Website for maintenance, security updates, or improvements. Whenever possible, users will be notified of planned downtime in advance. Vocal is not liable for any losses resulting from temporary service interruptions.


4. Fraud Prevention


4.1 Fraudulent Transactions

Vocal reserves the right to cancel, refuse, or investigate any transaction that appears suspicious, fraudulent, or in violation of these Terms & Conditions. This includes, but is not limited to:

  • Use of stolen payment methods or unauthorised credit cards.

  • Multiple failed payment attempts or mismatched billing details.

  • Unusual purchasing behaviour, such as bulk orders from new or unverified accounts.

  • Any attempt to bypass security measures or exploit vulnerabilities on the Website.

If a transaction is flagged as fraudulent, Vocal may temporarily suspend the User’s access and request verification before proceeding with the order.

4.2 Account Security

Users are responsible for maintaining the security and confidentiality of their account credentials (e.g., email, password). Vocal is not liable for unauthorised account access resulting from weak passwords, phishing attacks, or User negligence.

Users must:

  • Use a strong, unique password for their account.

  • Never share login credentials with third parties.

  • Notify Vocal immediately at info@vocalmockups.com if they suspect unauthorised access.

Vocal reserves the right to reset passwords or temporarily restrict access if suspicious activity is detected.

4.3 Chargebacks & Payment Disputes

All purchases on Vocal are final and non-refundable, except where legally required. Initiating a chargeback or payment dispute without first contacting Vocal for resolution may result in:

  • Immediate suspension or termination of the User’s account.

  • The revocation of access to previously purchased Mockups.

  • Further legal action, if applicable.

If a User believes a charge was made in error, they should contact info@vocalmockups.com before escalating the issue to their payment provider. Vocal reserves the right to challenge fraudulent chargebacks and provide evidence of the transaction to the payment processor.


5. Access to External Resources


5.1 Third-Party Services

Vocal integrates third-party services to facilitate transactions and website functionality, including but not limited to:

  • Payment gateways – All payments are processed securely through Shopify Payments, PayPal, or other authorised providers.

  • Digital downloads – Purchased Mockups are delivered directly through Shopify’s digital download system.

  • Website integrations – The Website may use external tools for analytics, email marketing, and customer support.

These third-party services operate under their own terms and policies, which Users are encouraged to review.

5.2 No Liability for Third-Party Failures

While Vocal aims to provide a seamless experience, it cannot be held liable for any errors, service disruptions, or failures caused by third-party providers, including:

  • Payment processing errors or declined transactions.

  • Issues with Shopify’s digital download system, including failed or delayed file access.

  • Downtime or technical failures affecting Shopify or other integrated services.

Users experiencing payment or download issues should first check Shopify’s support resources before contacting Vocal.


6. Purchase Process


6.1 How to Purchase

Users can purchase Mockups through the Website by following these steps:

  1. Browse & Select – Users can explore the available Mockups on vocalmockups.com and select their preferred items.

  2. Add to Cart – Chosen Mockups are added to the shopping cart.

  3. Review & Checkout – Users can review their order and proceed to checkout.

  4. Enter Payment Details – Payments are processed securely through Shopify Payments, PayPal, or other authorised providers.

  5. Complete Purchase – Upon successful payment, the order is confirmed, and the User is granted access to their digital files.

All purchases are subject to the licensing terms set out in these Terms & Conditions.

6.2 Order Confirmation & Delivery

  • Email Confirmation – After completing a purchase, the User will receive an order confirmation email with transaction details.

  • Digital Access – Purchased Mockups will be delivered via Shopify’s digital download system. A download link will be provided immediately after checkout and in the confirmation email.

  • Access Issues – If a User experiences any issues accessing their files, they should first check their spam/junk email folder. If the issue persists, they can contact Vocal at info@vocalmockups.com for assistance.

Once a digital Mockup has been downloaded, it cannot be returned or refunded, except where legally required.


7. Licensing


7.1 Standard License

The Standard License is designed for individuals and businesses looking to use Mockups exclusively for personal and self-promotional projects. This license does not permit any commercial or client-based work.

7.1.1 Scope of the Standard License

  • The Standard License is perpetual, meaning there are no expiration or renewal requirements.

  • The license covers unlimited personal projects, provided they comply with the restrictions outlined below.

  • Company size does not affect eligibility—any individual or business may purchase a Standard License.

  • The license is non-transferable and applies only to the purchaser.

7.1.2 Permitted Uses

Under the Standard License, Users may:

  • Use Mockups in internal presentations, personal portfolios, and self-promotional materials.

  • Display Mockups on personal websites, blogs, and social media accounts (organic/unpaid posts only).

  • Submit work containing Mockups for academic projects, student work, or design competitions.

  • Modify Mockups for personal use, provided the resulting work is not used commercially.

  • Use Mockups in non-commercial printed materials (e.g., personal posters, hobbyist prints).

7.1.3 Prohibited Uses

Under the Standard License, Users may not:

  • Use Mockups in any commercial project, including:

    • Business branding (e.g., logos, product packaging, business websites).

    • Paid client work or commissioned designs.

    • Paid advertising campaigns (e.g., Facebook Ads, Google Ads).

    • Commercial merchandise, physical or digital.

    • Crowdfunding campaigns or business fundraising materials.

  • Use Mockups in paid promotions, including:

    • Sponsored social media posts.

    • Influencer marketing campaigns.

    • Paid or boosted advertisements.

  • Resell, redistribute, sublicense, or share Mockups in any way, including:

    • Uploading Mockups to public websites, stock image platforms, or sharing groups.

    • Selling Mockups as standalone files or bundled assets.

    • Making Mockups available for free or paid download.

  • Claim authorship, copyright, or trademark rights over any Mockups.

  • Use Mockups in ways that violate the law, including:

    • Infringing on third-party copyrights or trademarks.

    • Associating Mockups with offensive, defamatory, or misleading content.

    • Creating false or deceptive endorsements using the Mockups.

7.1.4 Enforcement of Standard License Restrictions

  • Vocal monitors online marketplaces and social media for unauthorised use of its Mockups.

  • If a User is found to have violated the Standard License, Vocal reserves the right to revoke the license without refund and may pursue legal action for copyright infringement.

  • Users who require commercial usage must upgrade to a Commercial or Commercial Plus License before using Mockups in restricted ways.

7.2 Commercial License

The Commercial License is designed for small businesses, freelancers, and professionals who need Mockups for digital branding, social media, and marketing purposes. This license allows commercial usage within digital formats only, but does not permit physical products, packaging, or large-scale corporate use.

7.2.1 Scope of the Commercial License

  • The Commercial License is perpetual, meaning there are no expiration or renewal requirements.

  • The license covers unlimited digital projects, provided they comply with the restrictions outlined below.

  • The license applies to businesses with 1-10 employees. Companies with more than 10 employees must purchase a Commercial Plus License.

  • The license is non-transferable and applies only to the purchaser or business entity that made the purchase.

7.2.2 Permitted Uses

Under the Commercial License, Users may:

  • Use Mockups in digital branding materials for small businesses, including:

    • Social media content and organic brand promotion.

    • Website design and landing pages.

    • Digital advertisements, including Facebook Ads, Google Ads, and display banners.

    • Email marketing campaigns.

  • Use Mockups in paid promotional content, including:

    • Influencer and affiliate marketing (digital use only).

    • Sponsored social media posts.

    • Online marketing campaigns.

  • Modify Mockups to integrate into custom client work, provided the final deliverable is digital only and supplied in a non-editable format (e.g., JPEG, PNG, MP4).

7.2.3 Prohibited Uses

Under the Commercial License, Users may not:

  • Use Mockups in any printed or physical media, including:

    • Business cards, brochures, magazines, or other printed advertisements.

    • Product packaging or physical merchandise.

    • Out-of-home advertising, including billboards, vehicle wraps, or posters.

  • Resell, redistribute, sublicense, or share Mockups in any way, including:

    • Selling Mockups as standalone assets or bundled with other digital products.

    • Uploading Mockups to stock image platforms, public sharing sites, or digital marketplaces.

    • Making Mockups available for free or paid download.

  • Use Mockups for businesses with more than 10 employees.

    • Companies exceeding this threshold must upgrade to a Commercial Plus License.

  • Claim authorship, copyright, or trademark rights over any Mockups.

  • Use Mockups in ways that violate the law, including:

    • Infringing on third-party copyrights or trademarks.

    • Associating Mockups with offensive, defamatory, or misleading content.

    • Creating false or deceptive endorsements using the Mockups.

7.2.4 Enforcement of Commercial License Restrictions

  • Vocal actively monitors online marketplaces, social media, and commercial use cases for unauthorised usage of its Mockups.

  • If a User is found to have violated the Commercial License, Vocal reserves the right to revoke the license without refund and may pursue legal action for copyright infringement.

  • Businesses that exceed the 10-employee limit must upgrade to a Commercial Plus License or cease using the Mockups in any commercial capacity.

7.3 Commercial Plus License

The Commercial Plus License is designed for businesses of all sizes requiring extended use of Mockups across both digital and physical marketing channels. This license grants the broadest set of permissions, including print advertising, product packaging, and large-scale marketing campaigns.

7.3.1 Scope of the Commercial Plus License

  • The Commercial Plus License is perpetual, meaning there are no expiration or renewal requirements.

  • The license covers unlimited digital and physical projects, provided they comply with the restrictions outlined below.

  • There are no company size limitations—businesses of any size may purchase and use this license.

  • The license is non-transferable and applies only to the purchaser or business entity that made the purchase.

7.3.2 Permitted Uses

Under the Commercial Plus License, Users may:

  • Use Mockups for all digital applications allowed under the Commercial License, including:

    • Websites, digital branding, and advertisements.

    • Social media content, influencer collaborations, and paid promotions.

    • Digital marketing campaigns and client work (non-editable final files only).

  • Use Mockups in physical and printed media, including:

    • Business cards, brochures, magazines, and corporate presentations.

    • Product packaging, including labels, retail displays, and branded merchandise.

    • Marketing collateral such as flyers, posters, and in-store displays.

  • Use Mockups in out-of-home (OOH) advertising, including:

    • Billboards, transit advertisements, and posters.

    • Large-scale branding campaigns, event signage, and trade show materials.

  • Use Mockups in client projects, provided that:

    • The final product is delivered in a non-editable format (e.g., JPEG, PNG, MP4).

    • Each Mockup is used for a single client project unless additional licenses are purchased.

7.3.3 Prohibited Uses

Under the Commercial Plus License, Users may not:

  • Resell, redistribute, sublicense, or share Mockups in any way, including:

    • Selling or offering Mockups as standalone assets or bundled with other design files.

    • Uploading Mockups to stock image platforms, public sharing sites, or digital marketplaces.

    • Making Mockups available for free or paid download.

  • Use the same Mockup across multiple unrelated client projects without purchasing additional licenses.

    • Each client project must have a dedicated license unless explicitly agreed otherwise.

  • Claim authorship, copyright, or trademark rights over the original Mockups.

    • Mockups remain the intellectual property of Vocal, and no exclusive ownership rights are granted.

  • Use Mockups in ways that violate the law, including:

    • Infringing on third-party copyrights or trademarks.

    • Associating Mockups with offensive, defamatory, or misleading content.

    • Creating false or deceptive endorsements using the Mockups.

7.3.4 Enforcement of Commercial Plus License Restrictions

  • Vocal monitors online marketplaces, print materials, and large-scale commercial use for unauthorised usage of its Mockups.

  • If a User is found to have violated the Commercial Plus License, Vocal reserves the right to revoke the license without refund and may pursue legal action for copyright infringement.

  • Businesses that require exclusive rights to a Mockup must contact Vocal for a custom licensing agreement.

7.4 Third Party Licensing

A User may purchase a license on behalf of a client, provided that:

  • The client meets the requirements of the selected license (e.g., company size, permitted uses).

  • The purchased license applies exclusively to that client and cannot be shared across multiple clients.

  • The client is made aware of and agrees to the terms and restrictions of the license.

  • The purchasing User may not retain rights to the Mockup for personal or commercial use after transferring the license to the client, unless a separate license is purchased.

  • If a business, agency, or freelancer purchases a license for a client, they must:

    • Disclose that the Mockup is licensed and not owned outright.

    • Ensure that the final deliverables follow the licensing restrictions (e.g., digital-only use for Commercial License holders, no resale of original Mockups).

  • The license remains non-transferable, meaning the client cannot sublicense, resell, or share the Mockup with third parties unless explicitly permitted under the chosen license.

  • If a client requires a broader license (e.g., a small business purchasing a Standard License but later using Mockups commercially), they must upgrade to the appropriate license before expanding usage.


8. Special Offers & Discounts

Vocal may offer discounts, promotional pricing, and bundle deals from time to time. These promotions are subject to the following terms:

8.1 Discount Codes

  • Vocal may provide discount codes for promotional purposes, which may apply to specific products, cart values, or limited-time sales.

  • Discount codes are non-transferable, non-exchangeable, and have no cash value.

  • Each discount code may have specific conditions, such as:

    • A minimum purchase requirement.

    • A maximum number of redemptions per User.

    • An expiration date.

    • A restriction on certain products or licenses.

  • Users may not:

    • Apply multiple discount codes to the same purchase, unless explicitly stated.

    • Share, resell, or distribute discount codes without Vocal’s permission.

    • Use discount codes on past purchases or in combination with other offers, unless otherwise permitted.

8.2 Bundle Deals

  • Vocal may offer bundle deals, where multiple Mockups are sold at a discounted price when purchased together.

  • Bundled products are sold as a package, and individual components cannot be refunded, exchanged, or separated unless otherwise stated.

  • The discount applies only at the time of purchase and cannot be applied retroactively.

  • If a bundle includes products with different licensing options, the entire bundle will be subject to the most restrictive license within the package unless otherwise specified.

8.3 Abuse of Promotions

  • Vocal reserves the right to cancel, revoke, or modify any discount or promotional offer if abuse is suspected. Abuse includes, but is not limited to:

    • Excessive use of discount codes beyond the intended limit.

    • Fraudulent activities, such as using multiple accounts to bypass usage restrictions.

    • Public sharing or resale of discount codes without authorisation.

    • Attempting to use expired or unauthorised discount codes.

  • If a purchase is found to have been made using a fraudulently obtained discount, Vocal may:

    • Revoke access to the purchased Mockups.

    • Require repayment of the discounted amount.

    • Suspend or ban the User’s account from future purchases.


9. Payment


All purchases made through Vocal are processed securely via third-party payment providers. By completing a purchase, the User agrees to the pricing, fees, and payment conditions outlined below.

9.1 Accepted Payment Methods

  • Vocal accepts payments via Shopify Payments, which may include the following methods:

    • Credit and debit cards (Visa, Mastercard, American Express, etc.).

    • PayPal and other digital wallets, where supported.

    • Other region-specific payment methods, as displayed at checkout.

  • All payments are processed in GBP (£) or another currency as specified at checkout. Users are responsible for any currency conversion fees applied by their bank or payment provider.

  • Vocal does not accept payments via cash, cheque, or direct bank transfer unless explicitly arranged.

9.2 Payment Security

  • All transactions are processed via Shopify’s secure payment system, which uses SSL encryption and fraud prevention measures to protect sensitive information.

  • Vocal does not store or process payment details directly. All payment information is handled by third-party payment processors in accordance with PCI DSS compliance standards.

  • If Shopify or any payment provider flags a transaction as high-risk or potentially fraudulent, Vocal reserves the right to cancel or delay the order until further verification is completed.

9.3 Failed Payments

  • If a User’s payment is declined or fails, the order will not be processed, and the User will not receive access to purchased Mockups.

  • Common reasons for failed payments include:

    • Insufficient funds.

    • Expired or incorrect payment details.

    • Bank restrictions or fraud prevention measures.

  • Users experiencing payment failures should:

    • Verify that their payment details are correct.

    • Contact their bank or payment provider for further assistance.

    • Attempt the purchase again using an alternative payment method.

  • If a successful payment is later reversed or disputed (e.g., chargeback), Vocal reserves the right to:

    • Revoke access to any previously purchased Mockups.

    • Suspend or terminate the User’s account.

    • Pursue further action, including debt recovery or legal claims if fraudulent chargebacks are suspected.


10. Pricing

Vocal sets and manages pricing for all Mockups sold on the Website. By making a purchase, Users agree to the pricing structure in place at the time of the transaction.

10.1 Displayed Prices

  • All prices on the Website are displayed in GBP (£) unless otherwise specified.

  • Prices may be shown inclusive or exclusive of applicable taxes, depending on the User’s location.

  • The total amount payable, including any applicable taxes, will be displayed at checkout before payment is processed.

10.2 Currency & Taxes

  • If a User is purchasing from outside the United Kingdom, additional local taxes, duties, or currency conversion fees may apply.

  • Vocal is not responsible for any bank fees, exchange rate fluctuations, or third-party charges applied by a User’s payment provider.

  • Where required by law, Value Added Tax (VAT) or other applicable sales taxes will be added to the purchase price.

  • Users purchasing from locations where VAT is applicable may see tax included at checkout, depending on local tax laws and Shopify’s tax calculation settings.

10.3 Price Adjustments & Promotions

  • Vocal reserves the right to change product prices at any time without prior notice.

  • If a User purchases a Mockup before a discount or price change is applied, they are not entitled to a refund or adjustment for the difference.

  • Promotional pricing, discount codes, or bundle offers may be time-limited and subject to availability.

  • Vocal may introduce new products, discontinue existing Mockups, or modify pricing based on market conditions, demand, or operational costs.


11. Shipping & Delivery

Vocal exclusively sells digital products. No physical goods are shipped, and all Mockups are delivered electronically.

11.1 Digital-Only Products

  • All Mockups available on the Website are digital assets and are not physically shipped.

  • Upon successful purchase, Users will receive access to their files via Shopify’s digital download system.

  • No shipping fees apply to any purchase.


12. Right of Withdrawal


Due to the nature of digital products, purchases made on the Website are non-refundable, except in specific legal circumstances. Users acknowledge and accept this condition before completing a purchase.

12.1 No Right of Withdrawal for Digital Goods

  • Under UK and EU consumer law (Consumer Contracts Regulations 2013, Article 28(3)), Users waive their right of withdrawal once a digital product has been downloaded.

  • As all purchases on the Website involve instant access to digital files, Users do not have the right to cancel or request a refund after downloading a Mockup.

  • The User was charged but never received access to their purchased Mockup.

Refunds will not be granted in cases where:

  • The User changes their mind after purchasing.

  • The User claims dissatisfaction with the product but the file functions correctly and matches the description.

  • The User misunderstood the licensing terms or failed to review them before purchasing.

  • The User fails to download the product within the provided timeframe and did not request assistance.

12.3 Acknowledgment by Users

  • Before completing a purchase, Users are clearly informed that:

    • All sales are final due to the digital nature of the products.

    • Once a Mockup is downloaded, the right of withdrawal no longer applies.

  • By proceeding with a purchase, the User expressly consents to this policy and confirms their understanding that they will not be eligible for a refund except under the conditions stated above.


13. Intellectual Property Rights

All Mockups and associated content available on the Website are protected by copyright, trademark, and intellectual property laws. Users are granted a limited, non-exclusive, non-transferable license to use purchased Mockups under the terms set out in these Terms & Conditions.

13.1 Ownership of Assets

  • All Mockups remain the sole intellectual property of Vocal. Purchasing a Mockup grants the User a license to use the file, but does not transfer ownership of the asset.

  • Users do not acquire any copyright, trademark, or proprietary rights over the Mockups.

  • Vocal retains the right to sell, license, modify, or discontinue any Mockup at its discretion.

13.2 User Responsibilities

  • Users may not claim ownership of any Mockup, even if modifications are made to the file.

  • Users may not resell, redistribute, or sublicense Mockups in any form, including:

    • Uploading Mockups to stock image platforms, public sharing sites, or digital marketplaces.

    • Making Mockups available for free or paid download.

    • Incorporating Mockups into software, design tools, or template generators.

  • Users must ensure that any use of Mockups complies with the licensing terms set out in these Terms & Conditions.

13.3 Trademark & Logo Restrictions

  • Users may not use any Mockup, in whole or in part, as part of a trademark, service mark, or logo.

  • Users may not register or attempt to trademark any work derived from a Vocal Mockup.

  • If a Mockup is used in branding or marketing materials, Users acknowledge that they do not hold exclusive rights to that design.

  • Vocal reserves the right to take legal action against any unauthorised use of its intellectual property in trademarks or branding.


14. Electronic Storage & Distribution

14.1 User Storage Obligations

    • The same Mockup is being used across multiple unrelated client projects without additional licenses.

  • Users must provide requested proof within a reasonable timeframe when asked. Failure to comply may result in license revocation or further action.

15.2 Compliance Penalties

  • If a User is found to have violated the licensing terms, Vocal reserves the right to:

    • Revoke the license without refund.

    • Demand additional license purchases to cover unauthorised usage.

    • Charge penalty fees for non-compliant commercial or client use.

    • Pursue legal action for copyright infringement, unauthorised resale, or other intellectual property violations.

  • Users found to be repeatedly misusing Mockups may have their accounts suspended or banned from future purchases.

15.3 Reporting Violations

  • Users who suspect that a Mockup has been misused, illegally redistributed, or used outside of licensing terms can report violations to info@vocalmockups.com.

  • Reports should include:

    • Details of the suspected misuse (e.g., unauthorised resale, misuse in commercial branding, redistribution).

    • Screenshots or links to where the violation has occurred, if applicable.

    • Any relevant information to help Vocal assess and address the issue.

  • Vocal reserves the right to investigate reported violations and take appropriate action as necessary.


16. Liability & Disclaimers

Vocal provides its Mockups and services on an "as is" basis, without any express or implied warranties. Users acknowledge that they use the Website and its products at their own risk.

16.1 Limited Liability

  • To the fullest extent permitted by law, Vocal shall not be liable for:

    • Any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or business opportunities arising from the use or inability to use the Mockups or Website.

    • Any claims by third parties resulting from a User’s misuse or unauthorised distribution of Mockups.

    • Any technical issues, errors, or compatibility problems relating to software or hardware used to access or modify Mockups.

  • Vocal’s total liability, under any claim arising from the use of its products, shall be limited to the amount paid by the User for the specific Mockup in question.

16.2 Service Interruptions

  • Vocal does not guarantee uninterrupted or error-free access to the Website, and shall not be held liable for any temporary downtime, maintenance periods, or technical failures that may affect availability.

  • Service interruptions may occur due to:

    • Scheduled maintenance or updates.

    • Issues with third-party providers (e.g., Framer hosting, Shopify transactions).

    • Security threats, cyberattacks, or unforeseen technical failures.

  • Vocal will make reasonable efforts to restore service as soon as possible but assumes no liability for any damages, losses, or disruptions caused by service interruptions.

Vocal shall not be held liable for any failure or delay in performing its obligations under these Terms & Conditions due to events beyond its reasonable control. This includes, but is not limited to, natural disasters, acts of war, government restrictions, cyberattacks, technical failures, labour strikes, or disruptions to third-party services (e.g., Shopify, payment processors, or website hosting providers). In such cases, Vocal will make reasonable efforts to resume operations as soon as possible but shall not be responsible for any losses incurred due to these unforeseen events.

6.1 How to Purchase

Users can purchase Mockups through the Website by following these steps:

  1. Browse & Select – Users can explore the available Mockups on vocalmockups.com and select their preferred items.

  2. Add to Cart – Chosen Mockups are added to the shopping cart.

  3. Review & Checkout – Users can review their order and proceed to checkout.

  4. Enter Payment Details – Payments are processed securely through Shopify Payments, PayPal, or other authorised providers.

  5. Complete Purchase – Upon successful payment, the order is confirmed, and the User is granted access to their digital files.

All purchases are subject to the licensing terms set out in these Terms & Conditions.

6.2 Order Confirmation & Delivery

Once a digital Mockup has been downloaded, it cannot be returned or refunded, except where legally required.

  • Company size does not affect eligibility—any individual or business may purchase a Standard License.

  • The license is non-transferable and applies only to the purchaser.


7.1.2 Permitted Uses

Under the Standard License, Users may:

  • Use Mockups in internal presentations, personal portfolios, and self-promotional materials.

  • Display Mockups on personal websites, blogs, and social media accounts (organic/unpaid posts only).

  • Submit work containing Mockups for academic projects, student work, or design competitions.

  • Modify Mockups for personal use, provided the resulting work is not used commercially.

  • Use Mockups in non-commercial printed materials (e.g., personal posters, hobbyist prints).


7.1.3 Prohibited Uses

Under the Standard License, Users may not:

  • Claim authorship, copyright, or trademark rights over any Mockups.

  • Use Mockups in ways that violate the law, including:

    • Infringing on third-party copyrights or trademarks.

    • Associating Mockups with offensive, defamatory, or misleading content.

    • Creating false or deceptive endorsements using the Mockups.


7.1.4 Enforcement of Standard License Restrictions

  • Vocal monitors online marketplaces and social media for unauthorised use of its Mockups.

  • If a User is found to have violated the Standard License, Vocal reserves the right to revoke the license without refund and may pursue legal action for copyright infringement.

  • Users who require commercial usage must upgrade to a Commercial or Commercial Plus License before using Mockups in restricted ways.

7.2 Commercial License

The Commercial License is designed for small businesses, freelancers, and professionals who need Mockups for digital branding, social media, and marketing purposes. This license allows commercial usage within digital formats only, but does not permit physical products, packaging, or large-scale corporate use.

7.2.1 Scope of the Commercial License

  • The Commercial License is perpetual, meaning there are no expiration or renewal requirements.

  • The license covers unlimited digital projects, provided they comply with the restrictions outlined below.

  • The license applies to businesses with 1-10 employees. Companies with more than 10 employees must purchase a Commercial Plus License.

  • The license is non-transferable and applies only to the purchaser or business entity that made the purchase.


7.2.2 Permitted Uses

Under the Commercial License, Users may:

  • Use Mockups in digital branding materials for small businesses, including:

    • Social media content and organic brand promotion.

    • Website design and landing pages.

    • Digital advertisements, including Facebook Ads, Google Ads, and display banners.

    • Email marketing campaigns.

  • Use Mockups in paid promotional content, including:

    • Influencer and affiliate marketing (digital use only).

    • Sponsored social media posts.

    • Online marketing campaigns.

  • Modify Mockups to integrate into custom client work, provided the final deliverable is digital only and supplied in a non-editable format (e.g., JPEG, PNG, MP4).

7.2.3 Prohibited Uses

Under the Commercial License, Users may not:

  • Use Mockups in any printed or physical media, including:

    • Business cards, brochures, magazines, or other printed advertisements.

    • Product packaging or physical merchandise.

    • Out-of-home advertising, including billboards, vehicle wraps, or posters.

  • Resell, redistribute, sublicense, or share Mockups in any way, including:

    • Selling Mockups as standalone assets or bundled with other digital products.

    • Uploading Mockups to stock image platforms, public sharing sites, or digital marketplaces.

    • Making Mockups available for free or paid download.

  • Use Mockups for businesses with more than 10 employees.

    • Companies exceeding this threshold must upgrade to a Commercial Plus License.

  • Claim authorship, copyright, or trademark rights over any Mockups.

  • Use Mockups in ways that violate the law, including:

    • Infringing on third-party copyrights or trademarks.

    • Associating Mockups with offensive, defamatory, or misleading content.

    • Creating false or deceptive endorsements using the Mockups.


7.2.4 Enforcement of Commercial License Restrictions

  • Vocal actively monitors online marketplaces, social media, and commercial use cases for unauthorised usage of its Mockups.

  • If a User is found to have violated the Commercial License, Vocal reserves the right to revoke the license without refund and may pursue legal action for copyright infringement.

  • Businesses that exceed the 10-employee limit must upgrade to a Commercial Plus License or cease using the Mockups in any commercial capacity.


7.3 Commercial Plus License

The Commercial Plus License is designed for businesses of all sizes requiring extended use of Mockups across both digital and physical marketing channels. This license grants the broadest set of permissions, including print advertising, product packaging, and large-scale marketing campaigns.

7.3.1 Scope of the Commercial Plus License

  • The Commercial Plus License is perpetual, meaning there are no expiration or renewal requirements.

  • The license covers unlimited digital and physical projects, provided they comply with the restrictions outlined below.

  • There are no company size limitations—businesses of any size may purchase and use this license.

  • The license is non-transferable and applies only to the purchaser or business entity that made the purchase.


7.3.2 Permitted Uses

Under the Commercial Plus License, Users may:

  • Use Mockups for all digital applications allowed under the Commercial License, including:

    • Websites, digital branding, and advertisements.

    • Social media content, influencer collaborations, and paid promotions.

    • Digital marketing campaigns and client work (non-editable final files only).

  • Use Mockups in physical and printed media, including:

    • Business cards, brochures, magazines, and corporate presentations.

    • Product packaging, including labels, retail displays, and branded merchandise.

    • Marketing collateral such as flyers, posters, and in-store displays.

  • Use Mockups in out-of-home (OOH) advertising, including:

    • Billboards, transit advertisements, and posters.

    • Large-scale branding campaigns, event signage, and trade show materials.

  • Use Mockups in client projects, provided that:

    • The final product is delivered in a non-editable format (e.g., JPEG, PNG, MP4).

    • Each Mockup is used for a single client project unless additional licenses are purchased.


7.3.3 Prohibited Uses

Under the Commercial Plus License, Users may not:

  • Resell, redistribute, sublicense, or share Mockups in any way, including:

    • Selling or offering Mockups as standalone assets or bundled with other design files.

    • Uploading Mockups to stock image platforms, public sharing sites, or digital marketplaces.

    • Making Mockups available for free or paid download.

  • Use the same Mockup across multiple unrelated client projects without purchasing additional licenses.

    • Each client project must have a dedicated license unless explicitly agreed otherwise.

  • Claim authorship, copyright, or trademark rights over the original Mockups.

    • Mockups remain the intellectual property of Vocal, and no exclusive ownership rights are granted.

  • Use Mockups in ways that violate the law, including:

    • Infringing on third-party copyrights or trademarks.

    • Associating Mockups with offensive, defamatory, or misleading content.

    • Creating false or deceptive endorsements using the Mockups.


7.3.4 Enforcement of Commercial Plus License Restrictions

  • Vocal monitors online marketplaces, print materials, and large-scale commercial use for unauthorised usage of its Mockups.

  • If a User is found to have violated the Commercial Plus License, Vocal reserves the right to revoke the license without refund and may pursue legal action for copyright infringement.

  • Businesses that require exclusive rights to a Mockup must contact Vocal for a custom licensing agreement.


7.4 Third Party Licensing

A User may purchase a license on behalf of a client, provided that:

  • The client meets the requirements of the selected license (e.g., company size, permitted uses).

  • The purchased license applies exclusively to that client and cannot be shared across multiple clients.

  • The client is made aware of and agrees to the terms and restrictions of the license.

  • The purchasing User may not retain rights to the Mockup for personal or commercial use after transferring the license to the client, unless a separate license is purchased.

  • If a business, agency, or freelancer purchases a license for a client, they must:

    • Disclose that the Mockup is licensed and not owned outright.

    • Ensure that the final deliverables follow the licensing restrictions (e.g., digital-only use for Commercial License holders, no resale of original Mockups).

  • The license remains non-transferable, meaning the client cannot sublicense, resell, or share the Mockup with third parties unless explicitly permitted under the chosen license.

  • If a client requires a broader license (e.g., a small business purchasing a Standard License but later using Mockups commercially), they must upgrade to the appropriate license before expanding usage.



8. Special Offers & Discounts

Vocal may offer discounts, promotional pricing, and bundle deals from time to time. These promotions are subject to the following terms:

8.1 Discount Codes

  • Vocal may provide discount codes for promotional purposes, which may apply to specific products, cart values, or limited-time sales.

  • Discount codes are non-transferable, non-exchangeable, and have no cash value.

  • Each discount code may have specific conditions, such as:

    • A minimum purchase requirement.

  • If a bundle includes products with different licensing options, the entire bundle will be subject to the most restrictive license within the package unless otherwise specified.


8.3 Abuse of Promotions

  • Vocal reserves the right to cancel, revoke, or modify any discount or promotional offer if abuse is suspected. Abuse includes, but is not limited to:

    • Excessive use of discount codes beyond the intended limit.

    • Fraudulent activities, such as using multiple accounts to bypass usage restrictions.

  • If a purchase is found to have been made using a fraudulently obtained discount, Vocal may:

    • PayPal and other digital wallets, where supported.

    • Other region-specific payment methods, as displayed at checkout.

  • All payments are processed in GBP (£) or another currency as specified at checkout. Users are responsible for any currency conversion fees applied by their bank or payment provider.

    • Pursue further action, including debt recovery or legal claims if fraudulent chargebacks are suspected.



10. Pricing

Vocal sets and manages pricing for all Mockups sold on the Website. By making a purchase, Users agree to the pricing structure in place at the time of the transaction.

  • All prices on the Website are displayed in GBP (£) unless otherwise specified.

  • Prices may be shown inclusive or exclusive of applicable taxes, depending on the User’s location.

  • If a User is purchasing from outside the United Kingdom, additional local taxes, duties, or currency conversion fees may apply.

15.2 Compliance Penalties

  • If a User is found to have violated the licensing terms, Vocal reserves the right to:

    • Revoke the license without refund.

    • Demand additional license purchases to cover unauthorised usage.

    • Charge penalty fees for non-compliant commercial or client use.

    • Pursue legal action for copyright infringement, unauthorised resale, or other intellectual property violations.

  • Users found to be repeatedly misusing Mockups may have their accounts suspended or banned from future purchases.


15.3 Reporting Violations

In such cases, Vocal will make reasonable efforts to resume operations as soon as possible but shall not be responsible for any losses incurred due to these unforeseen events.

    • Uploading Mockups to public websites, stock image platforms, or sharing groups.

    • Selling Mockups as standalone files or bundled assets.

    • Making Mockups available for free or paid download.

  • Claim authorship, copyright, or trademark rights over any Mockups.

  • Use Mockups in ways that violate the law, including:

    • Infringing on third-party copyrights or trademarks.

    • Associating Mockups with offensive, defamatory, or misleading content.

    • Creating false or deceptive endorsements using the Mockups.


7.1.4 Enforcement of Standard License Restrictions

  • Vocal monitors online marketplaces and social media for unauthorised use of its Mockups.

  • If a User is found to have violated the Standard License, Vocal reserves the right to revoke the license without refund and may pursue legal action for copyright infringement.

  • Users who require commercial usage must upgrade to a Commercial or Commercial Plus License before using Mockups in restricted ways.

7.2 Commercial License

The Commercial License is designed for small businesses, freelancers, and professionals who need Mockups for digital branding, social media, and marketing purposes. This license allows commercial usage within digital formats only, but does not permit physical products, packaging, or large-scale corporate use.

7.2.1 Scope of the Commercial License

  • The Commercial License is perpetual, meaning there are no expiration or renewal requirements.

  • The license covers unlimited digital projects, provided they comply with the restrictions outlined below.

  • The license applies to businesses with 1-10 employees. Companies with more than 10 employees must purchase a Commercial Plus License.

  • The license is non-transferable and applies only to the purchaser or business entity that made the purchase.


7.2.2 Permitted Uses

Under the Commercial License, Users may:

  • Use Mockups in digital branding materials for small businesses, including:

    • Social media content and organic brand promotion.

    • Website design and landing pages.

    • Digital advertisements, including Facebook Ads, Google Ads, and display banners.

    • Email marketing campaigns.

  • Use Mockups in paid promotional content, including:

    • Influencer and affiliate marketing (digital use only).

    • Sponsored social media posts.

    • Online marketing campaigns.

  • Modify Mockups to integrate into custom client work, provided the final deliverable is digital only and supplied in a non-editable format (e.g., JPEG, PNG, MP4).

7.2.3 Prohibited Uses

Under the Commercial License, Users may not:

  • Use Mockups in any printed or physical media, including:

    • Business cards, brochures, magazines, or other printed advertisements.

    • Product packaging or physical merchandise.

    • Out-of-home advertising, including billboards, vehicle wraps, or posters.

  • Resell, redistribute, sublicense, or share Mockups in any way, including:

    • Selling Mockups as standalone assets or bundled with other digital products.

    • Uploading Mockups to stock image platforms, public sharing sites, or digital marketplaces.

    • Making Mockups available for free or paid download.

  • Use Mockups for businesses with more than 10 employees.

    • Companies exceeding this threshold must upgrade to a Commercial Plus License.

  • Claim authorship, copyright, or trademark rights over any Mockups.

  • Use Mockups in ways that violate the law, including:

    • Infringing on third-party copyrights or trademarks.

    • Associating Mockups with offensive, defamatory, or misleading content.

    • Creating false or deceptive endorsements using the Mockups.


7.2.4 Enforcement of Commercial License Restrictions

  • Vocal actively monitors online marketplaces, social media, and commercial use cases for unauthorised usage of its Mockups.

  • If a User is found to have violated the Commercial License, Vocal reserves the right to revoke the license without refund and may pursue legal action for copyright infringement.

  • Businesses that exceed the 10-employee limit must upgrade to a Commercial Plus License or cease using the Mockups in any commercial capacity.


7.3 Commercial Plus License

The Commercial Plus License is designed for businesses of all sizes requiring extended use of Mockups across both digital and physical marketing channels. This license grants the broadest set of permissions, including print advertising, product packaging, and large-scale marketing campaigns.

7.3.1 Scope of the Commercial Plus License

  • The Commercial Plus License is perpetual, meaning there are no expiration or renewal requirements.

  • The license covers unlimited digital and physical projects, provided they comply with the restrictions outlined below.

  • There are no company size limitations—businesses of any size may purchase and use this license.

  • The license is non-transferable and applies only to the purchaser or business entity that made the purchase.


7.3.2 Permitted Uses

Under the Commercial Plus License, Users may:

  • Use Mockups for all digital applications allowed under the Commercial License, including:

    • Websites, digital branding, and advertisements.

    • Social media content, influencer collaborations, and paid promotions.

    • Digital marketing campaigns and client work (non-editable final files only).

  • Use Mockups in physical and printed media, including:

    • Business cards, brochures, magazines, and corporate presentations.

    • Product packaging, including labels, retail displays, and branded merchandise.

    • Marketing collateral such as flyers, posters, and in-store displays.

  • Use Mockups in out-of-home (OOH) advertising, including:

    • Billboards, transit advertisements, and posters.

    • Large-scale branding campaigns, event signage, and trade show materials.

  • Use Mockups in client projects, provided that:

    • The final product is delivered in a non-editable format (e.g., JPEG, PNG, MP4).

    • Each Mockup is used for a single client project unless additional licenses are purchased.


7.3.3 Prohibited Uses

Under the Commercial Plus License, Users may not:

  • Resell, redistribute, sublicense, or share Mockups in any way, including:

    • Selling or offering Mockups as standalone assets or bundled with other design files.

    • Uploading Mockups to stock image platforms, public sharing sites, or digital marketplaces.

    • Making Mockups available for free or paid download.

  • Use the same Mockup across multiple unrelated client projects without purchasing additional licenses.

    • Each client project must have a dedicated license unless explicitly agreed otherwise.

  • Claim authorship, copyright, or trademark rights over the original Mockups.

    • Mockups remain the intellectual property of Vocal, and no exclusive ownership rights are granted.

  • Use Mockups in ways that violate the law, including:

    • Infringing on third-party copyrights or trademarks.

    • Associating Mockups with offensive, defamatory, or misleading content.

    • Creating false or deceptive endorsements using the Mockups.


7.3.4 Enforcement of Commercial Plus License Restrictions

  • Vocal monitors online marketplaces, print materials, and large-scale commercial use for unauthorised usage of its Mockups.

  • If a User is found to have violated the Commercial Plus License, Vocal reserves the right to revoke the license without refund and may pursue legal action for copyright infringement.

  • Businesses that require exclusive rights to a Mockup must contact Vocal for a custom licensing agreement.


7.4 Third Party Licensing

A User may purchase a license on behalf of a client, provided that:

  • The client meets the requirements of the selected license (e.g., company size, permitted uses).

  • The purchased license applies exclusively to that client and cannot be shared across multiple clients.

  • The client is made aware of and agrees to the terms and restrictions of the license.

  • The purchasing User may not retain rights to the Mockup for personal or commercial use after transferring the license to the client, unless a separate license is purchased.

  • If a business, agency, or freelancer purchases a license for a client, they must:

    • Disclose that the Mockup is licensed and not owned outright.

    • Ensure that the final deliverables follow the licensing restrictions (e.g., digital-only use for Commercial License holders, no resale of original Mockups).

  • The license remains non-transferable, meaning the client cannot sublicense, resell, or share the Mockup with third parties unless explicitly permitted under the chosen license.

  • If a client requires a broader license (e.g., a small business purchasing a Standard License but later using Mockups commercially), they must upgrade to the appropriate license before expanding usage.



8. Special Offers & Discounts

Vocal may offer discounts, promotional pricing, and bundle deals from time to time. These promotions are subject to the following terms:

8.1 Discount Codes

  • Vocal may provide discount codes for promotional purposes, which may apply to specific products, cart values, or limited-time sales.

  • Discount codes are non-transferable, non-exchangeable, and have no cash value.

  • Each discount code may have specific conditions, such as:

    • A minimum purchase requirement.

    • A maximum number of redemptions per User.

    • An expiration date.

    • A restriction on certain products or licenses.

  • Users may not:

    • Apply multiple discount codes to the same purchase, unless explicitly stated.

    • Share, resell, or distribute discount codes without Vocal’s permission.

    • Use discount codes on past purchases or in combination with other offers, unless otherwise permitted.


8.2 Bundle Deals

  • Vocal may offer bundle deals, where multiple Mockups are sold at a discounted price when purchased together.

  • Bundled products are sold as a package, and individual components cannot be refunded, exchanged, or separated unless otherwise stated.

  • The discount applies only at the time of purchase and cannot be applied retroactively.

  • If a bundle includes products with different licensing options, the entire bundle will be subject to the most restrictive license within the package unless otherwise specified.


8.3 Abuse of Promotions

  • Vocal reserves the right to cancel, revoke, or modify any discount or promotional offer if abuse is suspected. Abuse includes, but is not limited to:

    • Excessive use of discount codes beyond the intended limit.

    • Fraudulent activities, such as using multiple accounts to bypass usage restrictions.

    • Public sharing or resale of discount codes without authorisation.

    • Attempting to use expired or unauthorised discount codes.

  • If a purchase is found to have been made using a fraudulently obtained discount, Vocal may:

    • Revoke access to the purchased Mockups.

    • Require repayment of the discounted amount.

    • Suspend or ban the User’s account from future purchases.



9. Payment


All purchases made through Vocal are processed securely via third-party payment providers. By completing a purchase, the User agrees to the pricing, fees, and payment conditions outlined below.

9.1 Accepted Payment Methods

  • Vocal accepts payments via Shopify Payments, which may include the following methods:

    • Credit and debit cards (Visa, Mastercard, American Express, etc.).

    • PayPal and other digital wallets, where supported.

    • Other region-specific payment methods, as displayed at checkout.

  • All payments are processed in GBP (£) or another currency as specified at checkout. Users are responsible for any currency conversion fees applied by their bank or payment provider.

  • Vocal does not accept payments via cash, cheque, or direct bank transfer unless explicitly arranged.


9.2 Payment Security

  • All transactions are processed via Shopify’s secure payment system, which uses SSL encryption and fraud prevention measures to protect sensitive information.

  • Vocal does not store or process payment details directly. All payment information is handled by third-party payment processors in accordance with PCI DSS compliance standards.

  • If Shopify or any payment provider flags a transaction as high-risk or potentially fraudulent, Vocal reserves the right to cancel or delay the order until further verification is completed.


9.3 Failed Payments

  • If a User’s payment is declined or fails, the order will not be processed, and the User will not receive access to purchased Mockups.

  • Common reasons for failed payments include:

    • Insufficient funds.

    • Expired or incorrect payment details.

    • Bank restrictions or fraud prevention measures.

  • Users experiencing payment failures should:

    • Verify that their payment details are correct.

    • Contact their bank or payment provider for further assistance.

    • Attempt the purchase again using an alternative payment method.

  • If a successful payment is later reversed or disputed (e.g., chargeback), Vocal reserves the right to:

    • Revoke access to any previously purchased Mockups.

    • Suspend or terminate the User’s account.

    • Pursue further action, including debt recovery or legal claims if fraudulent chargebacks are suspected.



10. Pricing

Vocal sets and manages pricing for all Mockups sold on the Website. By making a purchase, Users agree to the pricing structure in place at the time of the transaction.

10.1 Displayed Prices

  • All prices on the Website are displayed in GBP (£) unless otherwise specified.

  • Prices may be shown inclusive or exclusive of applicable taxes, depending on the User’s location.

  • The total amount payable, including any applicable taxes, will be displayed at checkout before payment is processed.


10.2 Currency & Taxes

  • If a User is purchasing from outside the United Kingdom, additional local taxes, duties, or currency conversion fees may apply.

  • Vocal is not responsible for any bank fees, exchange rate fluctuations, or third-party charges applied by a User’s payment provider.

  • Where required by law, Value Added Tax (VAT) or other applicable sales taxes will be added to the purchase price.

  • Users purchasing from locations where VAT is applicable may see tax included at checkout, depending on local tax laws and Shopify’s tax calculation settings.


10.3 Price Adjustments & Promotions

  • Vocal reserves the right to change product prices at any time without prior notice.

  • If a User purchases a Mockup before a discount or price change is applied, they are not entitled to a refund or adjustment for the difference.

  • Promotional pricing, discount codes, or bundle offers may be time-limited and subject to availability.

  • Vocal may introduce new products, discontinue existing Mockups, or modify pricing based on market conditions, demand, or operational costs.



11. Shipping & Delivery

Vocal exclusively sells digital products. No physical goods are shipped, and all Mockups are delivered electronically.

11.1 Digital-Only Products

  • All Mockups available on the Website are digital assets and are not physically shipped.

  • Upon successful purchase, Users will receive access to their files via Shopify’s digital download system.

  • No shipping fees apply to any purchase.


12. Right of Withdrawal


Due to the nature of digital products, purchases made on the Website are non-refundable, except in specific legal circumstances. Users acknowledge and accept this condition before completing a purchase.

12.1 No Right of Withdrawal for Digital Goods

  • Under UK and EU consumer law (Consumer Contracts Regulations 2013, Article 28(3)), Users waive their right of withdrawal once a digital product has been downloaded.

  • As all purchases on the Website involve instant access to digital files, Users do not have the right to cancel or request a refund after downloading a Mockup.


12.2 Legal Exceptions

A refund or replacement may only be issued in the following circumstances:

  • The purchased Mockup is defective, corrupted, or missing essential elements that prevent its intended use.

  • The incorrect Mockup was delivered due to an error on Vocal’s part.

  • The User was charged but never received access to their purchased Mockup.

  • Any other instance where a refund is required by applicable consumer protection laws.


Refunds will not be granted in cases where:

  • The User changes their mind after purchasing.

  • The User claims dissatisfaction with the product but the file functions correctly and matches the description.

  • The User misunderstood the licensing terms or failed to review them before purchasing.

  • The User fails to download the product within the provided timeframe and did not request assistance.


12.3 Acknowledgment by Users

  • Before completing a purchase, Users are clearly informed that:

    • All sales are final due to the digital nature of the products.

    • Once a Mockup is downloaded, the right of withdrawal no longer applies.

  • By proceeding with a purchase, the User expressly consents to this policy and confirms their understanding that they will not be eligible for a refund except under the conditions stated above.



13. Intellectual Property Rights

All Mockups and associated content available on the Website are protected by copyright, trademark, and intellectual property laws. Users are granted a limited, non-exclusive, non-transferable license to use purchased Mockups under the terms set out in these Terms & Conditions.

13.1 Ownership of Assets

  • All Mockups remain the sole intellectual property of Vocal. Purchasing a Mockup grants the User a license to use the file, but does not transfer ownership of the asset.

  • Users do not acquire any copyright, trademark, or proprietary rights over the Mockups.

  • Vocal retains the right to sell, license, modify, or discontinue any Mockup at its discretion.


13.2 User Responsibilities

  • Users may not claim ownership of any Mockup, even if modifications are made to the file.

  • Users may not resell, redistribute, or sublicense Mockups in any form, including:

    • Uploading Mockups to stock image platforms, public sharing sites, or digital marketplaces.

    • Making Mockups available for free or paid download.

    • Incorporating Mockups into software, design tools, or template generators.

  • Users must ensure that any use of Mockups complies with the licensing terms set out in these Terms & Conditions.


13.3 Trademark & Logo Restrictions

  • Users may not use any Mockup, in whole or in part, as part of a trademark, service mark, or logo.

  • Users may not register or attempt to trademark any work derived from a Vocal Mockup.

  • If a Mockup is used in branding or marketing materials, Users acknowledge that they do not hold exclusive rights to that design.

  • Vocal reserves the right to take legal action against any unauthorised use of its intellectual property in trademarks or branding.



14. Electronic Storage & Distribution

14.1 User Storage Obligations
Users are responsible for keeping copies of their downloads.

14.2 No Unauthorised Sharing
Files cannot be distributed outside permitted use.

14.3 Digital Security Measures
The company may use watermarks or tracking technologies.


15. Audits

Vocal reserves the right to monitor and verify the use of its Mockups to ensure compliance with licensing terms. If misuse is suspected, Vocal may take appropriate action, including audits, compliance enforcement, and legal proceedings.

15.1 Right to Audit Usage

  • Vocal may request proof of how a User has used a purchased Mockup to confirm compliance with the applicable license.

  • Audits may be conducted if:

    • There is evidence or suspicion of unauthorised use, redistribution, or sublicensing.

    • A User is reported for violating licensing restrictions.

    • The same Mockup is being used across multiple unrelated client projects without additional licenses.

  • Users must provide requested proof within a reasonable timeframe when asked. Failure to comply may result in license revocation or further action.


15.2 Compliance Penalties

  • If a User is found to have violated the licensing terms, Vocal reserves the right to:

    • Revoke the license without refund.

    • Demand additional license purchases to cover unauthorised usage.

    • Charge penalty fees for non-compliant commercial or client use.

    • Pursue legal action for copyright infringement, unauthorised resale, or other intellectual property violations.

  • Users found to be repeatedly misusing Mockups may have their accounts suspended or banned from future purchases.


15.3 Reporting Violations

  • Users who suspect that a Mockup has been misused, illegally redistributed, or used outside of licensing terms can report violations to info@vocalmockups.com.

  • Reports should include:

    • Details of the suspected misuse (e.g., unauthorised resale, misuse in commercial branding, redistribution).

    • Screenshots or links to where the violation has occurred, if applicable.

    • Any relevant information to help Vocal assess and address the issue.

  • Vocal reserves the right to investigate reported violations and take appropriate action as necessary.



16. Liability & Disclaimers

Vocal provides its Mockups and services on an "as is" basis, without any express or implied warranties. Users acknowledge that they use the Website and its products at their own risk.

16.1 Limited Liability

  • To the fullest extent permitted by law, Vocal shall not be liable for:

    • Any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or business opportunities arising from the use or inability to use the Mockups or Website.

    • Any claims by third parties resulting from a User’s misuse or unauthorised distribution of Mockups.

    • Any technical issues, errors, or compatibility problems relating to software or hardware used to access or modify Mockups.

  • Vocal’s total liability, under any claim arising from the use of its products, shall be limited to the amount paid by the User for the specific Mockup in question.


16.2 Service Interruptions

  • Vocal does not guarantee uninterrupted or error-free access to the Website, and shall not be held liable for any temporary downtime, maintenance periods, or technical failures that may affect availability.

  • Service interruptions may occur due to:

    • Scheduled maintenance or updates.

    • Issues with third-party providers (e.g., Framer hosting, Shopify transactions).

    • Security threats, cyberattacks, or unforeseen technical failures.

  • Vocal will make reasonable efforts to restore service as soon as possible but assumes no liability for any damages, losses, or disruptions caused by service interruptions.


16.3 User Responsibility

  • Users acknowledge that they are solely responsible for:

    • Ensuring that Mockups are suitable for their intended use before purchase.

    • Properly storing and backing up purchased Mockups, as Vocal does not guarantee indefinite file availability.

    • Complying with all applicable laws and licensing restrictions when using the Mockups.

    • Any modifications, customisations, or alterations made to the Mockups after purchase.

  • Vocal is not responsible for misuse, user error, or technical limitations that may prevent a User from using a Mockup effectively.



17. Data Protection & Privacy

Vocal is committed to protecting User privacy and handling personal data in compliance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and other applicable laws.

17.1 Collection of Personal Data

  • When Users interact with the Website, Vocal may collect and process the following types of personal data:

    • Account Information: Name, email address, and any details provided when making a purchase.

    • Payment Details: Payment method information (processed securely via third-party providers; Vocal does not store credit card details).

    • Transaction Data: Purchase history and downloads to ensure compliance with licensing terms.

    • Technical Data: IP address, browser type, and device information for website functionality and fraud prevention.

    • Communication Data: Any messages sent to Vocal via email or contact forms.

  • Personal data is collected for the following purposes:

    • To process and fulfil orders made on the Website.

    • To provide customer support and respond to inquiries.

    • To prevent fraud, security threats, and unauthorised transactions.

    • To comply with legal obligations related to data protection and financial regulations.


17.2 Third-Party Data Sharing

  • Vocal may share personal data with third-party service providers strictly for the purposes outlined in 17.1. These providers include:

    • Shopify Payments, PayPal, and other payment processors to handle transactions securely.

    • Framer (website host) for platform functionality and performance monitoring.

    • Email service providers (e.g., marketing platforms) for account-related communications and updates.

  • Data is never sold, rented, or shared for marketing purposes without the User’s explicit consent.

  • Vocal may disclose personal data if required by law enforcement, regulatory authorities, or legal proceedings.


17.3 User Rights

Under UK GDPR, Users have the following rights regarding their personal data:

  • Right to Access – Users can request a copy of the personal data Vocal holds about them.

  • Right to Correction – Users can request that inaccurate or outdated data be updated.

  • Right to Deletion ("Right to be Forgotten") – Users can request that their personal data be erased, except where retention is required for legal, tax, or fraud prevention purposes.

  • Right to Object to Processing – Users can object to their data being used for certain purposes, such as marketing communications.

  • Right to Data Portability – Users can request that their personal data be transferred to another service provider.

To exercise any of these rights, Users can contact Vocal at info@vocalmockups.com. Requests will be processed in accordance with legal obligations and may require identity verification.



18. Modifications to Terms

Vocal reserves the right to update or modify these Terms & Conditions at any time to reflect changes in legal requirements, business operations, or industry standards. Any updates will be posted on the Website with the "Last Updated" date displayed, and significant changes may be communicated via email or a Website notice. Users acknowledge that continued use of the Website or purchases after updates constitute acceptance of the revised Terms. If a User does not agree to any modifications, their sole remedy is to discontinue use of the Website and its products.


19. Online Dispute Resolution


If a dispute arises between a User and Vocal, both parties agree to first attempt to resolve the matter informally through direct communication by contacting info@vocalmockups.com. If a resolution cannot be reached, Users may seek further guidance through the UK Trading Standards consumer dispute resolution services or pursue legal action under the applicable laws outlined in Section 20 (Governing Law). Nothing in this clause limits Vocal’s right to seek legal remedies where necessary.



20. Governing Law


These Terms & Conditions are governed by and interpreted in accordance with the laws of England and Wales. By using the Website, Users agree that any disputes or claims arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer protection laws require otherwise. Vocal complies with all applicable UK regulations governing digital transactions, consumer rights, and data protection.



21. Dispute Resolution


If a dispute arises between a User and Vocal that cannot be resolved through informal communication, both parties agree to seek resolution through mediation or alternative dispute resolution (ADR) methods before pursuing legal action. If a resolution is not reached, disputes shall be settled in the courts of England and Wales, in accordance with the governing law stated in Section 20. This clause does not limit Vocal’s right to take immediate legal action where necessary, including in cases of intellectual property infringement or breach of contract.



22. Force Majeure

Vocal shall not be held liable for any failure or delay in performing its obligations under these Terms & Conditions due to events beyond its reasonable control. This includes, but is not limited to, natural disasters, acts of war, government restrictions, cyberattacks, technical failures, labour strikes, or disruptions to third-party services (e.g., Shopify, payment processors, or website hosting providers). In such cases, Vocal will make reasonable efforts to resume operations as soon as possible but shall not be responsible for any losses incurred due to these unforeseen events.
